Terms and Conditions of Alahaberry
Please read these Terms and Conditions ("Agreement") carefully before using the Alahaberry website (www.alahaberry.com) and mobile application (hereinafter referred to as "Alahaberry" or "Platform"). This Agreement sets forth the legally binding terms and conditions for your use of the Alahaberry platform.
By accessing or using Alahaberry, you agree to be bound by these Terms and Conditions. If you do not agree with any part of the Agreement, you must not use the Alahaberry platform.
1. General Terms
1.1. Alahaberry is an online platform that connects buyers and sellers, facilitating transactions between them. Sellers list their products on Alahaberry, and when a buyer requests a product, Alahaberry acts as an intermediary to contact the seller and arrange for the delivery of the item to the buyer on behalf of the seller.
1.2. Alahaberry reserves the right to modify, suspend, or discontinue the platform or any part of it at any time without prior notice.
1.3. By using Alahaberry, you confirm that you are at least 18 years old and have the legal capacity to enter into this Agreement.
2. Account Registration and Responsibilities
2.1. In order to use Alahaberry as a seller, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to maintain its accuracy.
2.2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share your account credentials with anyone else. Alahaberry shall not be liable for any loss or damage arising from your failure to comply with this obligation.
2.3. You agree to promptly notify Alahaberry of any unauthorized use of your account or any other breach of security.
3. Selling on Alahaberry
3.1. As a seller on Alahaberry, you are responsible for the accuracy, quality, and legality of the products you list. You must ensure that your products comply with all applicable laws, regulations, and intellectual property rights.
3.2. Alahaberry charges a 10% commission on the total sale price of each product sold through the platform. The commission will be deducted from the seller's earnings.
3.3. You grant Alahaberry a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the product listings and related content for the purpose of operating and promoting the Alahaberry platform.
3.4. Alahaberry reserves the right to remove any product listings or content that violates these Terms and Conditions or is otherwise objectionable, without prior notice.
4. Buyer-Seller Communication and Transactions
4.1. Alahaberry facilitates communication between buyers and sellers. Sellers will be notified of buyer requests for their products through the platform, and they are responsible for fulfilling the orders promptly and accurately.
4.2. Sellers are responsible for providing accurate product descriptions, pricing information, and shipping details.
4.3. Buyers agree to provide accurate and complete information when making a purchase on Alahaberry. They are responsible for reviewing and agreeing to any terms, conditions, or policies provided by the sellers.
4.4. Alahaberry does not guarantee the availability, quality, or legality of the products listed on the platform. Buyers should exercise caution and use their judgment before making any purchase.
5. Disputes and Resolution
5.1.
Alahaberry endeavors to provide a safe and secure environment for its users. In the event of any dispute between buyers and sellers, Alahaberry may, at its sole discretion, facilitate communication or take any necessary action to resolve the dispute. However, Alahaberry is not obligated to mediate or resolve disputes between users.
5.2. Alahaberry shall not be responsible for any loss or damage incurred as a result of a transaction between users of the platform. Users are solely responsible for resolving any disputes or issues arising from their transactions.
6. Intellectual Property
6.1. Alahaberry and its associated trademarks, logos, and content are the exclusive property of Alahaberry. You agree not to use, reproduce, modify, or distribute any of Alahaberry's intellectual property without prior written consent.
7. Limitation of Liability
7.1. Alahaberry shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to your use of the platform or any products purchased through it.
8. Governing Law and Jurisdiction
8.1. This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of [Your Jurisdiction].
